The Community Support Service “Here for You” is located at December 13th Street No. 209, 500164 Braşov. We are a community service, for adults aged between 35 and 65 who are in situations of social isolation, risk of poverty and exclusion through low income, precarious housing, illiteracy or poor education.

Beneficiaries are granted social assistance, a plan for intervention and care and are guided, if necessary to other services. These can include social counseling, finding information, emotional support, professional orientation, careers advice and psychological/psychosocial counselling. We also support with legal advice, social integration/reintegration therapies, emotional support – religious education for integration/social reintegration, facilitating access to general education, facilitating access to education social mediation and any other relevant support.

REGULATIONS

Organisation and functioning of the social service provided in the community:

COMMUNITY ASSISTANCE SERVICE “AICI PENTRU TINE”

ART. 1. General provisions. Definition

“THE COMMUNITY ASSISTANCE SERVICE” AICI PENTRU TINE “” is a social assistance unit of private interest established by the Association “AICI PENTRU TINE”.
The Rules of organisation and functioning are a document of the social service “Community Assistance service” AICI PENTRU TINE “, approved by the decision of The General Assembly of the Members of the ASSOCIATION “AICI PENTRU TINE” from the date of 04.05.2017 on which it was established, in order to ensure its functioning in compliance with the applicable minimum quality standards and to ensure the access of beneficiary persons to information on admission conditions, the services offered.

Article. 2 Identification of the social service

The social service “Community Assistance Service” Here for You “, belongs to the category of day centers for assistance and support to other people in need, code 8899 CZ-PN-V, Community support services . The social Service is set up and managed by the private provider ASSOCIATION “AICI PENTRU TINE”, Accredited according to the CERTIFICATE of Accreditation series AF No. 002125 DATED 10.04.2015, tax code private vendor 34124127. The Social service is based In Street 13 December 209, 500164 Brasov. The subject of social service activity: other social assistance activities without accommodation, NCA, cod caen 8899.

Article. 3 Purpose of the social service

The purpose of the social service “Community Assistance service” “AICI PENTRU TINE” is to ensure the information and counselling of the beneficiaries, as well as informing the population of social rights and social services available in to support vulnerable people in overcoming difficulties, preventing and combating the risk of social exclusion, increasing quality of life and promoting social inclusion.

In Order to achieve this purpose, advice and information, evaluation and social intervention, guidance and representation services shall be granted to enter into social rights and benefit from social services granted in the community.

Services are granted to persons who are in various situations of difficulty, vulnerability:
– Persons and families with no income or low incomes,
– Homeless people,
– Persons deprived of liberty,
– People with different addictions (consumption of alcohol and other toxic substances),
– Persons with psychiatric conditions/persons with non-institutionalised disabilities,
– Young people leaving the child protection system
– Single or dependent elderly persons
– People living in marginalised communities

The social Service has the role of conducting activities and providing social services, organized at Community level to solve the medical-social problems of the individual, in order to maintain them in their own living environment

Article. 4 Legal Framework for establishment, organisation and operation

(1) the social service “community assistance service” Aici Pentru Tine”” operates in compliance with the provisions of the general framework for the organization and functioning of social Services, governed by Law No. 292/2011, with subsequent amendments, as well as other secondary normative acts applicable to the domain.

(2) applicable minimum quality Standard: Order No. 2126/05.11.2014 on the approval of minimum quality standards for the accreditation of social services for elderly persons, homeless persons, young people who have left the system of child protection and other categories of adult persons in difficulty, as well as for services granted in the community, services granted in the integrated system and to social cants; annex 7 – Minimum quality standards for social services granted in the community for adult persons.

Article. 5 Principles underlying the grant of social service

(1) the social service “community assistance service” AICI PENTRU TINE” organised and operated in compliance with the general principles governing the national social assistance system, as well as the specific principles underlying the provision of social services provided for in the specific legislation, international conventions ratified by law and other international acts in matters to which Romania is a party, as well as in the minimum quality standards applicable.

(2) the specific principles underpinning the provision of social services in the social service “community assistance service” AICI PENTRU TINE “are as follows:

(a) The operation under the immediate intervention procedure, without the need to conclude the contract for the provision of services;
(b) Integrated intervention;
(c) The flexibility of the service organisation where intervention is required;
(d) The possibility of rendering the services without assessing the person’s needs, depending on the type of intervention, being sufficient to register persons in the register or in attendance lists;
(e) To promote a positive image in the community of categories of vulnerable persons or in difficult situations;
(f) Promoting civic behaviour and assuming social responsibility by all social actors in order to prevent risk situations;
(g) Respect and priority promotion of the interest of the beneficiary;
(h) Protection and promotion of the rights of beneficiaries with regard to equal opportunities and treatment, equal participation, self-determination, autonomy and personal dignity and the undertaking of non-discriminatory and positive actions with the beneficiaries;;
(i) encouraging individual initiatives of beneficiary persons and their active involvement in resolving difficult situations;
(j) Ensuring professional intervention through multi-disciplinary teams and ensuring confidentiality and professional ethics;
(k) The prime responsibility of the person, the family about the development of their social integration capacities and the active involvement in solving the difficulty situations they may face at some point;
(l) Promoting collaborative relations with the public welfare service, as well as with all social actors.
(m) The participation of beneficiaries, according to which beneficiaries participate in the formulation and implementation of policies with direct impact on them, the implementation of individualised social media programmes and actively engage in community life, through forms of association or directly, through voluntary activities undertaken for the benefit of vulnerable persons;
(n) the activization, according to which social assistance measures are aimed at encouraging employment, for the purposes of social integration/reintegration and the increase in the quality of life of the person, and the strengthening of the family nucleus;
(o) respect for the right to self-determination, according to which each person has the right to make their own choices, irrespective of their social values, ensuring that it does not threaten the rights or legitimate interests of others;

Article. 6 Beneficiaries of social services

The Beneficiaries of social services granted under the social service “community assistance service” AICI PENTRU TINE”” are vulnerable adults at risk of marginalisation and social exclusion:

Persons and families with no income or low income,
Homeless people,
Persons deprived of liberty,
Individuals with different addiction (alcohol and other toxic substances),
Persons with psychiatric conditions/persons with non-institutionalised disabilities,
Young people leaving the child protection system;
Single or dependent elderly persons;
People living in marginalised communities.

(2). Conditions for accessing the services:

According to the principles listed in art. 5, para. 2, in particular with the principle of participation of beneficiaries (described in paragraph g), of the action (described in letter m) and respect for the right to self-determination (as described in paragraph l), eligible beneficiaries are those requesting and they may be granted social services for advice, information and representation for which the social service is licensed.
According to the minimum quality standards, the social service has their own procedure for accessing social services, available at the premises of the service provision.

In Order to access the advisory and social intervention services, the beneficiaries will present:

– Civil Status acts (if they hold them)
– Medical Documents
– Certificates of classification in degrees of disability and/or decisions laying down their working capacity
– Any other act, at the request of the specialist staff, necessary to provide services or/or social benefits
Information and guidance services can be provided on the spot, and without assessing the needs of the person, if he does not wish to provide information in this regard. In these situations, the registration of persons in the Register with the indication of the this aspect.
Contracts for the granting of social services shall be terminated only for beneficiaries who follow a social integration/reintegration programme which requires the planning of activities for a specified period of time, i.e. at least 6 months. The social integration/reintegration programme necessarily includes elements that complement each other and an integrated approach from the specialist, according to which:
– To ensure the full social functioning of the person, as a full member of the family, community and society, social services should be linked to all the needs of the beneficiary and granted integrated with a wide range of measures and services in Economic, educational, health, cultural, residential, social life environment, as appropriate.

The admission/rejection decision to access social information and counselling services provided in the social service shall be taken by the specialist staff at the first meeting with the beneficiary by applying the specific instrument: Initial assessment.

Where, at the first assessment or during the measures taken, the mutually agreed needs require an integrated approach, the decision to accept/reject shall be taken on the proposal of the specialist who carried out the assessment, with the opinion of the Coordinator Social service.

The beneficiary’s contribution is not a financial one,but of involvement and genuine engagement:
– Social assistance measures aim to encourage employment, for the purpose of social integration/reintegration and the increase in the quality of life of the person, and the strengthening of the family nucleus;
– The responsibility of the person and/or family regarding the development of their social integration capacities and the active involvement in resolving the situations of difficulty which they may face at a given moment is paramount;

(3). Conditions for termination of services:

According to the minimum quality standards, the compartment has its own procedure for terminating services to the beneficiary, available at the premises of the service provision.
Social Services shall cease in the following situations:
– The objective of the intervention plan has been achieved and there is no need to revise it
– The beneficiary fails to attend meetings established with the case officer for a period of 3 months, without subsequently being able to provide an objective reason for this (sickness, departure of the locality, etc.)
– The beneficiary waives the intervention at certain stages of the intervention plan.
– The beneficiary’s repetitive behaviour through the emotional and/or physical situation of the case officer, despite the transfer of the event to another specialist in the social service.
– In the process of granting social services, the beneficiary requires social services for which the social service does not have the right of licensing and by granting them, the case officer would exceed his professional and service duties.

(4) the persons receiving social services provided in the social service “community assistance service” AICI PENTRU TINE “”have the following rights:

(a) Respect their fundamental rights and freedoms, without discrimination on the basis of race, sex, religion, opinion or any other personal or social circumstance;

(b) Participate in the decision-making process in the provision of social services, namely the decision on social intervention to be applied to them, as appropriate;

(c) To ensure confidentiality of the information provided and received;

(d) To be assured of the continuity/transfer/recommendation of the social services provided, as long as the conditions which have led to the situation of difficulty are maintained;

(e) To be protected, both the beneficiary and their possessions, by the law when they do not have the ability to do that themselves;

(f) Be informed of the risk situations as well as on social rights;

(g) benefit from all medical and social services, depending on the needs felt, offered in the social service.

(5) the persons receiving social services provided in the framework of the social service “Community Assistance Service” AICI PENTRU TINE “” have the following obligations:

(a) To provide accurate information on identity, family, social, medical and economic situation;

(b) To participate, in relation to the age and the situation of dependence, in the process of providing social services;

(c) To communicate any change in relation to their personal and economic and medical situation;

(d) To comply with the provisions of this Regulation;

(e) To in no way adversely affect the staff employed, in particular the case officer in the process of granting services;

Article. 7 Activities and functions of the social service community assistance service “Aici Pentru Tine”

The Main functions of the social service are as follows:

A) the provision of social services in the community by ensuring the following activities:
1. Initial Assessment: carried out on the first meeting with the beneficiary by the social worker to identify the individual and family needs, on the basis of which the intervention plan is drawn up. In this process, the person receives free information on the social rights that he/she can benefit from, but also the advice needed to overcome the situations of difficulty. The initial assessment may also take into account the realisation of the social diagnosis at group and community level and the elaboration of the community service plan.

2. Elaboration of the Intervention Plan: comprises social assistance measures, i.e. the recommended services for resolving the identified situations of need or social risk, as well as the benefits of social assistance to which the person has right

3. Application of the Intervention plan:

– Conducting information and counselling activities,

– Extracurricular education according to the given situation,

– Activities to promote the social inclusion of disadvantaged people,

– Procurement of identity and civil status documents,

– Assessment of needs for social rights: support for obtaining the necessary documents in the degree of disability and for establishing incapacity for work,

– Facilitating access to various medical services (basic and specialised) in collaboration with various hospitals and polyclinics;

(b) To utilise the potential of community members in order to prevent situations of neglect, abuse, abandonment, violence, social exclusion, etc., by ensuring the following activities:
1. Awareness-raising and information activities of the population by enhancing educational content that promotes tolerance to vulnerable social groups, as well as the design and implementation of supported educational campaigns and enhancing awareness of diversity, addressed to both the general public and decision-makers: public servants and employers;
2. Promoting social participation by ensuring regular public information on the plans for the performance of public institutions, as well as dissemination through media channels of successful interactions between beneficiaries and specialist staff of the social service;
3. Develop a procedure for the identification, reporting and resolution of cases of abuse and negligence among beneficiaries;

(c) Informing potential beneficiaries, public authorities and the general public about its field of activity and promoting the rights of beneficiaries and a positive image thereof, promoting human rights in general, as well as preventing situations of difficulty in which the vulnerable categories belonging to the category of beneficiary persons may enter, in accordance with its purpose, by ensuring the following activities:
1. Awareness-raising and information activities of the population by enhancing educational content that promotes tolerance to vulnerable social groups, as well as the design and implementation of supported educational campaigns and enhancing awareness of diversity, addressed to both the general public and decision-makers: public servants and employers;
2. Promoting social participation by ensuring regular public information on the plans for the performance of public institutions, as well as dissemination through media channels of successful interactions between beneficiaries and specialist staff of the social service.
3. Informing beneficiaries and the general public about the existence of the charter of rights of beneficiaries through various communication pathways, including the organisation of meetings with vulnerable groups;
4. Holding and making available to beneficiaries and the general public through various means of mediatization, information materials on the services offered and activities carried out: written materials, brochures, films and/or information photos or advertising, posted on its own website;

(d) To ensure the quality of social services by carrying out the following activities:
1. Production of standardised instruments used in the process of granting services;

2. Carrying out regular evaluations of the services rendered;

3. Develop procedures and questionnaires whereby specialist staff can measure the satisfaction of beneficiaries with regard to the activities undertaken and decisions taken in planning, development, administration and evaluation social services granted;

(e) Management of the financial, material and human resources of the social service by carrying out the following activities:

Coordination of the social service, through specialist staff, graduate of higher education;
2. The continuing training of specialist staff on knowledge of the procedures used for the granting of licensed social services;
Of knowledge and compliance with the legal provisions on the management and management of financial and material resources for social services;
Encouraging the service provider to create the conditions for the active involvement of staff and beneficiaries in developing a development plan, with a view to improving activities and improving the quality of life for beneficiaries
Encouraging, in addition to their employees, voluntary volunteer employment, according to the law;
The review, whenever necessary, of job descriptions for employees;
The annual assessment of the staff employed, noting the degree of performance of their performances;
Drawing up proposals on investment, public procurement, materials necessary for the proper functioning of activities, staff improvement plan, social service budget;

Article. 8 organizational Structure, number of posts and categories of staff

(1) the social service “community assistance service” Aici Pentru Tine”” operates with a total of 11 Staff, according to the general ASSEMBLY decision OF THE MEMBERS of the association “here for You” No. 04 dated 04.05.2017, of which:

a) management staff: 1 post;

b) Specialist care and assistance personnel; specialized and auxiliary staff: 7 posts;

c) staff with administrative functions, management, maintenance-repairs, service: 3 posts;

d) volunteers, respecting volunteering legislation: 8 Volunteers

Article. 9 Senior Staff

The Management Staff is: 1 post
2. The duties of the management staff shall be:
a) Ensure the coordination, guidance and control of activities carried out by the staff of the service and propose disciplinary sanctions to the competent body for employees who do not properly perform their duties, in compliance with legal provisions in the field of provision of social services, Labour Code, etc.;
b) Draw up the general reports on the activity of the social service, the State of implementation of the objectives and draw up information presented to the social service provider;
c) proposes the participation of specialist staff in training and refresher programmes;
d) Collaborate with other centres/other social service providers and/or other civil society structures in actions aimed at improving the social assistance of vulnerable groups;
e) is responsible for the quality of the activities carried out by the staff of the service and has, within the limits of competence, organisational measures to improve these activities or, where appropriate, formulate proposals in this respect;
f) organise the work of staff and ensure compliance with working time and regulation of organisation and functioning;
g) Draw up the project of the service budget;
h) Ensure that contracts for the provision of social services are concluded with beneficiaries, as appropriate;
i) Other duties provided for in the applicable minimum quality standard.

Article. 10 Specialized and auxiliary Staff

1. The specialised Staff shall consist of:
A) 1 social worker
b) 1 psychologist

(2) The Tasks of the specialised staff concern mainly the preparation of the intervention plan:
a) Ensure the stages of the process of granting social services, in compliance with the provisions of the law, of the applicable minimum standards of quality and of this regulation;
b) Collaborate with specialists from other centres in order to resolve cases, identify resources;
c) Monitor compliance with minimum quality standards;
d) Prepare periodic reports on the activity carried out;
e) Other duties provided for in the applicable minimum quality standard.

The main purpose of the posts for the social worker, including the psychologist, is:
· Assessment of people in crisis situations and intervention to improve their situation by providing information and counselling services;
· Weekly verification or whenever there is a need for social services granted by the association.

Article. 11 administrative staff, household, maintenance-repairs, service

(1) the administrative staff shall provide the activities ancillary to the social service: human resources, financial-accounting services, acquisitions, etc. It consists of:

a) financial-accounting officer;

b) Project manager;

c) assistant manager.

(2) staff wages shall be established according to the legislation applicable to staff, based on the state of approved functions, depending on the number of approved staff and the financial resources allocated.

(3) for staff in the social service, the Provisions of Law No. 53/2003 – The Labour Code, with subsequent amendments and additions, as well as with the other normative acts in force governing employment relationships.

Article. 15 Social Service Financing

(1) in estimating the revenue and expenditure budget, the social service “community assistance service” Aici Pentru Tine”” shall consider providing the resources necessary for the provision of social services at least at the level applicable minimum standards of quality.

(2) the financing of expenditure shall be ensured, under the law, of the following sources:

Local budgets of municipalities, towns and municipalities, respectively the local budgets of the Bucharest municipality sectors;
Donations, sponsorships or other contributions from natural or legal persons in the country and abroad;
Own income;
Reimbursable and non-refundable external funds;
Other sources of financing, in accordance with the legislation in force.

Article. 16 Final Provisions

(1) The provisions of this regulation shall be brought to the attention of both the beneficiaries or legal representatives and the personnel of the social service on signature basis, having the obligation to know and apply it.

(2). The staff shall be responsible for the civil, criminal or administrative responsibility, as appropriate, for failing to comply with the duties provided for in this ROF and in the post cards, for deviations from ethics and professional deontology.

(3) All employees are required to fulfil and other duties in the field of activity of the service to which they belong, arising from the normative acts in force, as well as the duties of service ordered by the management of the association intended to converge to the full realisation of the duties of the social service, to the improvement of its activity.

(4) Employees are required to ensure the security of material with secret content, responding to the leakage of information and documents from those compartments.

(5) Full failure and within the legal term of service tasks shall be sanctioned under labour law.

(6) This regulation for the organisation and functioning of the social service, is drawn up in compliance with the framework model approved by Government Decision 867/2015 for the approval of the nomenclature of social services and shall be supplemented by law with the Acts Regulations in force or is amended with the provisions of the legislation in force governing this area of activity. It Is approved by The General Assembly decision of the members of the Association “AICI PENTRU TINE” no. 04 dated 04.05.2017.

(7) the registration and archiving of the data shall be carried out in accordance with the legal rules in force.
